1. Introduction

Welcome to EVoly, a volunteer management platform operated by NaturKultur e.V. ("we," "us," or "our"), a registered association in Germany.

These Terms of Service ("Terms") govern your access to and use of the EVoly platform, including our web application and mobile applications (collectively, the "Platform"). By accessing or using EVoly, you agree to be bound by these Terms.

NaturKultur e.V. acts as the operator and technical provider of the EVoly platform.

Participating organizations remain solely responsible for the management, supervision, and coordination of their volunteers, projects, and activities conducted through the Platform.

2. Eligibility

You must be at least 18 years old to use EVoly. By using the Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration and Security

3.1 Account Creation

To access EVoly, you must create an account by providing accurate and complete information, including your name, email address, and other required details. You may be invited to register by a Super Admin, Organization Admin, or Volunteer Coordinator.

3.2 Account Security

You are responsible for taking reasonable measures to maintain the security of your account, including:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Configuring multi-factor authentication (MFA) as required
• Notifying us immediately of any unauthorized access or security breach
• We reserve the right to suspend or temporarily restrict accounts if suspicious activity, security risks, or violations of these Terms are detected.

3.3 Account Types and Roles

EVoly operates with the following user roles, each with specific permissions:

• Super Admin: Full system access and administrative control
• Organization Admin: Management of users and operations within assigned organizations
• Volunteer Coordinator: Project and task management, volunteer supervision
• Volunteer: Access to assigned projects, tasks, and personal profile

4. Use of the Platform

4.1 Permitted Use

You may use EVoly solely for:

• Managing volunteer activities and organizations (if you are an admin or coordinator)
• Participating in volunteer projects and completing assigned tasks (if you are a volunteer)
• Communicating with other users within your organization or projects
• Accessing the AI chatbot assistant for platform-related inquiries

4.2 Prohibited Conduct

You agree not to:

• Violate any applicable laws or regulations
• Impersonate any person or entity
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to the Platform or other users' accounts
• Use the Platform for any commercial purpose without our written consent
• Interfere with or disrupt the Platform's functionality
• Scrape, harvest, or collect user information without authorization
• Use the Platform to harass, abuse, or harm others
• Use the Platform in a way that violates the internal policies or legal obligations of your organization

4.3 Content Standards

When providing feedback, creating journal entries, or communicating through the Platform:

• You must not post illegal, defamatory, or offensive content
• You must respect the privacy and rights of others
• You must comply with your organization's policies and guidelines

4.4. Enforcement

We reserve the right to investigate violations of these Terms and may remove content, suspend accounts, or terminate access to the Platform where violations are detected.

5. User Content and Data

5.1 Your Content

You retain ownership of any content you create on the Platform, including:

• Profile information
• Task feedback
• Personal journal entries (private to you)
• Uploaded documents

5.2 License to Us

By submitting content to EVoly, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display your content solely for the purpose of operating, maintaining, and improving the Platform. This license terminates when your content is deleted, except where retention is required by law or for legitimate legal purposes.

5.3 Journal Entries

Your personal journal entries are private and will not be:

• Shared with other users without your consent
• Used to train AI models or language learning models
• Accessed by admins except as required by law

5.4 Organization Data

Content related to your volunteer work (projects, tasks, check-ins, feedback to coordinators) may be accessed by authorized personnel within your organization, including Organization Admins and Volunteer Coordinators.

5.5 Data Controller Responsibilities

Each participating organization acts as the data controller for personal data related to its volunteers and activities. NaturKultur e.V. acts as a technical service provider and processes data on behalf of organizations as necessary to operate the Platform.

6. AI Chatbot

6.1 Chatbot Functionality

EVoly includes an AI-powered chatbot assistant (powered by Amazon Lex, Amazon Bedrock, and other services provided by Amazon) to help you with:

• Platform navigation and feature guidance
• Answering questions based on provided learning documents
• General conversational assistance

6.2 Chatbot Limitations

The chatbot:

• Provides information based on its training data and may not always be accurate
• Cannot provide legal, medical, or professional advice
• Has limited knowledge outside of platform-related topics
• Should not be relied upon as a sole source for decisions with legal, medical, safety, or financial implications

6.3 Public vs. Private Chatbot

• Public Chatbot: Available to non-registered users with access only to non-confidential, public information
• In-App Chatbot: Available to logged-in users with access to platform-specific guidance

6.4 AI Data Handling

User-generated content will not be used to train external artificial intelligence models unless explicitly stated and permitted by applicable data protection laws. AI processing is limited to providing assistance within the Platform.

7. Subscriptions and Payments

As of the date of these Terms, EVoly does not offer individual paid subscriptions to end users. Currently, EVoly is provided to users through their affiliated organizations. Any payment arrangements are managed at the organizational level.

8. Organization Management

8.1 Multi-Tenant Structure

EVoly operates as a multi-tenant platform where multiple NGOs can manage their volunteers independently. Each organization maintains its own:

• User base (Organization Admins, Coordinators, Volunteers)
• Projects and tasks
• Documents and branding
• Team structure

8.2 Organization Responsibilities

Organizations using EVoly are responsible for:

• Ensuring their users comply with these Terms
• Maintaining accurate organization information
• Managing user roles and permissions appropriately
• Complying with applicable labor and volunteer management laws

8.3 Volunteer Responsibility

Organizations are solely responsible for the recruitment, supervision, safety, and insurance of volunteers participating in their programs. NaturKultur e.V. does not supervise volunteer activities and assumes no responsibility for actions performed by volunteers or organizations.

9. Data Protection and Privacy

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using EVoly, you consent to our data practices as described in the Privacy Policy.

• We comply with the General Data Protection Regulation (GDPR) and applicable EU data protection laws
• You have rights to access, correct, delete, and export your personal data
• We implement appropriate security measures to protect your information

9.1 Data Retention

Personal data will only be retained for as long as necessary to fulfill the purposes for which it was collected, unless longer retention is required by law or legitimate operational needs.

10. Intellectual Property

10.1 Our Rights

The EVoly Platform, including its software, design, features, logos, and content (excluding user-generated content), is owned by NaturKultur e.V. and protected by copyright, trademark, and other intellectual property laws.

10.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use EVoly for its intended purposes, subject to these Terms.

10.3 Restrictions

You may not:

• Copy, modify, or create derivative works of the Platform
• Reverse engineer or attempt to extract source code
• Remove or alter any proprietary notices
• Use our trademarks or branding without written permission

11. Third-Party Services

EVoly integrates with third-party services, including:

• Amazon Web Services (AWS) for cloud hosting
• Amazon Lex for AI chatbot functionality
• Email service providers for notifications

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

12. Availability and Modifications

Where changes materially affect users’ rights or obligations, we will provide reasonable prior notice where feasible.

12.1 Service Availability

We strive to maintain EVoly's availability but do not guarantee uninterrupted or error-free service. The Platform may be unavailable due to:

• Scheduled maintenance
• Technical difficulties
• Circumstances beyond our control

12.2 Changes to the Platform

We reserve the right to:

• Modify, suspend, or discontinue any feature of EVoly
• Update the Platform with new features or improvements
• Change these Terms by posting updated Terms with a new "Last Updated" date

Continued use of the Platform after changes constitutes acceptance of the modified Terms.

We do not guarantee any specific uptime or availability level unless explicitly agreed in a separate written service agreement.

13. Termination

13.1 Termination by You

You may terminate your account at any time through your account settings or by contacting your Organization Admin or us directly.

13.2 Termination by Us

We may suspend or terminate your account, with reasonable justification, if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your account remains inactive for an extended period
• To protect the security, integrity, or reputation of the Platform or its users.
• We discontinue the Platform

13.3 Effect of Termination

Upon termination:

• Your access to EVoly will cease
• Your personal data will be handled according to our Privacy Policy and data retention requirements
• Provisions of these Terms that by their nature should survive will remain in effect

14. Disclaimers

14.1 "As Is" Basis

EVOLY IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

14.2 Volunteer Activities

EVoly is a management tool for coordinating volunteer activities. We do not:

• Employ or supervise volunteers
• Assume responsibility for volunteer safety or activities
• Provide insurance coverage for volunteer activities
• Verify the accuracy of information provided by organizations or users

Each organization is responsible for the safety, supervision, and insurance of their volunteers.

14.3 AI Chatbot

The AI chatbot is provided for convenience and informational purposes only. We do not guarantee the accuracy, completeness, or reliability of chatbot responses.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

15.1 Excluded Damages

NaturKultur e.V., its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including:

• Loss of profits, data, or goodwill
• Service interruptions
• Personal injury or property damage
• Damages resulting from volunteer activities

15.2 Liability Cap

Our total liability for any claims arising from these Terms or your use of EVoly shall not exceed €100 or the amount paid by your organization to us for the use of EVoly in the twelve (12) months preceding the claim, whichever is greater.

15.3 Exceptions

Nothing in these Terms excludes or limits our liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded under German or EU law

16. Indemnification

You agree to indemnify, defend, and hold harmless NaturKultur e.V., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your violation of these Terms
• Your use of the Platform
• Your violation of any rights of another party
• Content you submit to the Platform

17. Dispute Resolution

17.1 Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict of law principles.

17.2 Jurisdiction

Any disputes arising from these Terms or your use of EVoly shall be subject to the exclusive jurisdiction shall be Bremen, Germany, to the extent permitted by law.

17.3 Informal Resolution

Before initiating formal legal proceedings, you agree to first contact us to attempt to resolve the dispute informally.

18. General Provisions

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and NaturKultur e.V. regarding EVoly.

18.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

18.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

18.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms to any affiliate or successor.

18.5 Language

These Terms may be translated into other languages for convenience. In case of conflict, the German version shall prevail.
